Delhi Court Sends 17 India Gate Protestors to Judicial Custody for Police Assault and State Offences

The drama unfolded at India Gate where a pollution protest turned fiery and fierce! On Monday, a Delhi court ordered 17 people, including 11 women, into three days’ judicial custody. These protestors were nabbed on tough charges including assault on police officers and plotting against the State. Judicial Magistrate Sahil Monga was on the case, hearing details from the Sansad Marg police station.
The accused faced serious charges: disobeying public servant orders, assault and obstruction of public servants, conspiracy against the State, and wrongful restraint under BNS provisions. The magistrate carefully reviewed the investigation and said, “The allegations are serious, and the matter is at an early stage of investigation. Identity verification of several accused persons is pending, and digital/electronic evidence is yet to be examined.” Because the accused weren’t cooperating well, the court said judicial custody was necessary to allow thorough investigation.
The police’s story is dramatic. On November 23, around 6:45 pm, these accused gathered near Parliament Street police station’s gate. They raised what the cops call “regressive slogans” against the government and police. Initially, they had protested at India Gate about the mysterious death of Naxalite leader Madvi Hidma and worsening pollution, prompting an FIR at Kartavya Path police station.
But things went further downhill. After the India Gate protest, the accused went to Parliament Street police station, blocked entrances, including the DCP office gate, and didn’t let police officers come or go. Even after being told that prohibitory orders under BNS Section 163 were in place in New Delhi, the protesters refused to back off.
When police tried to disperse the crowd, violence erupted. The protestors attacked police walls and caused injuries. The accused also denied sharing their identities and didn’t help the investigation. They carried posters supporting Madvi Hidma, and police suspect they might have links to other illegal acts.
The tension escalated further on Sunday when some protestors reportedly sprayed pepper spray on police personnel during the crackdown. Delhi Police called it "unusual and rare." In a related case, six protestors were arrested for this pepper spray attack and chanting slogans praising Madvi Hidma. They faced charges including assault or criminal force on a woman with intent to outrage her modesty.
In that hearing, five protestors got two days’ judicial custody, while one person was sent to an observation home until their age could be confirmed.
So, what started as a fight against pollution quickly turned into a full-blown confrontation with law and order, and Delhi’s courts are moving fast to handle the serious charges.
