Trump Administration Tightens Green Card Rules, Arrests Activists, Reveals 10 Risky Mistakes to Avoid
January 20, 2026
The Donald Trump administration is sending a clear message: having a Green Card doesn't guarantee permanent stay in the US anymore. Activists holding Green Cards have been arrested and deported as national security risks. Additionally, nationals from 75 countries are now banned from receiving Green Cards as the government checks how much welfare benefits they use.
Immigration attorney Moumita Rahman shared 10 common mistakes Green Card holders make that can risk their residency status:
1. Staying Outside the US Too Long: Trips over six months may suggest you abandoned your US residency. Rahman advises spending at least 9-10 months annually in the US.
2. Not Having Enough Ties to the US: Lack of real address, bank accounts, jobs, or family in the US can put your Green Card at risk.
3. Getting Convicted of Serious Crimes: Offenses like fraud, theft, domestic abuse, or causing harm can lead to losing your Green Card.
4. Failing to Pay Taxes: USCIS monitors tax filings strictly. Filing Form 1040 to report income is crucial.
5. Making a False Claim to USCIS: Claiming US citizenship or voting falsely causes irreversible Green Card revocation.
6. Missing Form I-751 Filing: Conditional Green Card holders must file this form 90 days before expiry to get permanent status.
7. Suspicion of Fake Marriage: Even genuine couples risk suspicion if they don't live a shared life.
8. Misrepresentation to Immigration Officials: Hiding facts like past deportations or lying about work history can cost your Green Card.
9. Not Updating USCIS on Address Changes: Green Card holders must notify USCIS within 10 days using Form AR11.
10. Voluntary Abandonment: Submitting Form I-407 means you give up your Green Card, only do this if you truly intend to leave residency.
Rahman emphasizes that Green Card holders should be very careful to avoid these pitfalls especially under the Trump administration's tougher immigration stance.
