Delhi HC Slams NGO for Misusing PILs Over Mosque Encroachments

The Delhi High Court on January 14, 2026, condemned the Save India Foundation for repeatedly filing public interest litigations (PILs) about encroachments by mosques in Delhi. A Division Bench led by Chief Justice Devendra Kumar Upadhyaya and Justice Tejas Karia said this was a "sheer misuse of PIL jurisdiction." The court questioned why the NGO focused only on one type of encroachment. It called the frequent PILs "disturbing" and asked, "Are you seeking your name in the Guinness Book of World Records?" The court also suggested the NGO help people struggling for basic amenities instead. The PILs claimed that a mosque and madrasa in south Delhi were encroaching on government land. The Delhi government admitted the structures were encroachments. However, the Delhi Waqf Board stated the mosque was a notified structure and that the Delhi Development Authority had helped mark the land boundaries. The court has scheduled further hearings on January 21.
