Delhi Court Sends 8 to 12-Day Judicial Custody Over Turkman Gate Mosque Violence

A Delhi court on Friday, January 9, 2026, sent eight accused to 12-day judicial custody for their alleged role in the violence near the Faiz-e-Elahi mosque in Turkman Gate. The violence broke out during a demolition drive. Five other accused, who faced stone pelting charges, applied for bail before Judicial Magistrate Sayesha Chada. Their defence lawyers claimed they were assaulted in jail. The court issued notices to Delhi Police and the jail superintendent, asking for medical records of the five accused before the next hearing. Lawyers for Mohammad Arib, Kashif, Adnan, Mohammad Kaif, and Sameer sought more time to prepare for bail hearings, which the court granted until January 13. So far, police have arrested 13 people including a juvenile. On Friday, the eight accused—Afaan, Adil, Shahnawaz, Amir Hamza, Ubadullah, Atharr, Mohammad Imran, and another Mohammad Imran—were produced before the court and remanded in custody until January 21. The court said the grounds of arrest were provided and that all accused seemed present at the violent site. Defence lawyers argued no video proof was shown, but Delhi Police said identification was based on constable reports and CCTV footage. Police charged the accused under Section 109 of Bharatiya Nyaya Sanhita for attempt to murder and other sections related to rioting and obstructing officials. Six police personnel were hurt during stone pelting, including injuries to the head. Defence said injuries were minor and no murder attempt was intended. The court said injury seriousness would be decided in trial. Advocates Tushar Kadian and Atul Srivastava appeared as Public Prosecutor and Additional Public Prosecutor, respectively. The violence erupted during a night-long anti-encroachment drive near the mosque on Tuesday-Wednesday. Police said a social media post wrongly claimed the mosque was being demolished, causing crowd anger. Around 150-200 people threw stones and bottles at police and MCD workers. MCD officials said 36,000 sq ft of encroachment was cleared—demolishing a diagnostic centre, banquet hall, and walls—but the mosque remained untouched.
