Delhi Govt Delays 2025 Act Fee Rules for Private Schools to Next Academic Year

On February 2, 2026, the Delhi government informed the Supreme Court it will not enforce the Delhi School Education (Transparency in Fixation and Regulation of Fees) Act, 2025, from the 2025-2026 academic year. This Act seeks to regulate fees in private schools in Delhi. Acting Chief Justice P.S. Narasimha noted, “It seems better sense has prevailed finally.” Earlier, the court had questioned the government’s plans for a rushed implementation. Justice Narasimha said, “Our concern was about the rushed implementation of the Act. We would have stayed. But better seems to have prevailed for them (Delhi government), and they have said the law would be implemented only from the next year.” Senior advocates Mukul Rohatgi and Shyam Divan pointed out the government still wants to apply the Act starting 2025-26 if it wins a case in the Delhi High Court. Mr. Rohatgi noted, “The fee for the 2025-2026 academic year was fixed in March-April 2025. The Act came into existence in December 2025. How can they apply the 2025 Act retrospectively?” Justice Narasimha replied that this issue should be settled in the High Court. The Supreme Court concluded its intervention after the government’s promise. The High Court has been asked to decide the petitions quickly. Earlier, the Supreme Court praised the Act’s goals but criticized forcing its implementation late in the academic year. The court had said, “We are completely in favour of the legislation, but its present form of implementation is unviable... You are forcing people overnight to get up and do it.” The new State law requires private schools to set up School Level Fee Regulation Committees including school management, teachers, parents, and an education nominee. These committees, along with district-level appellate bodies, will regulate any fee increases. The Act affects about 1000 schools and millions of students in Delhi.
