Supreme Court Continues Hearing Trinamool Congress Petitions on West Bengal Electoral Roll Discrepancies
January 22, 2026
The Supreme Court on Thursday, January 22, 2026, will continue to hear petitions from Trinamool Congress leaders. They claim there were problems during the Special Intensive Revision (SIR) in West Bengal that caused some voters to be wrongly left out of the electoral roll. The Court earlier said the Election Commission of India (ECI) has the "widest discretions" in conducting elections. However, the Court warned that the ECI's "deviations" during the SIR 2025 must not break the rules of natural justice or the Registration of Electors Rules of 1960.
Senior advocate Rakesh Dwivedi, representing the ECI, argued the SIR 2025 process was "sustainable". He referred to Article 324 of the Constitution, which gives the ECI the power to oversee elections and electoral rolls, along with Section 21(3) of the Representation of the People Act, 1950. The Court is scrutinizing the balance between the ECI’s authority and proper legal procedures in this significant election exercise.
