India Nears Rules to Mandate Labelling of AI-Generated Content, Says IT Secretary

The Indian government is close to finalising rules that will force large tech companies and social media platforms to label AI-generated content. IT Secretary S Krishnan said this step will help users spot synthetic media and prevent false information from being mistaken as truth. He announced this at a Nasscom event on Tuesday.
The new AI labelling regulations will affect providers of AI tools like ChatGPT, Grok, and Gemini, as well as social media platforms such as Facebook and YouTube. Krishnan explained, "Labelling something as AI-generated content offers people the opportunity to examine it...you know that it is AI-generated and that it is not masquerading as the truth."
The draft rules are in the final legal review stages. They propose that AI-generated images and videos must be marked clearly, covering at least 10 percent of the visual area or the first 10 percent of an audio clip. This will make it easier to identify deepfakes and other synthetic content.
In October, the government suggested changes to the IT rules to increase platform accountability for verifying and flagging fake AI media. The IT ministry highlighted the risks of deepfakes being used to spread misinformation, harm reputations, influence elections, or commit fraud.
When asked about the need for a separate AI Act, Krishnan said, "We are not having it tomorrow, or in the next session of Parliament, but in future we may need an Act. We believe right now, the tools that we have, in terms of laws and Acts, are adequate to cover the requirements, but we don't rule out the possibility of having to enact new legislation in order to address any concerns."
