ELCITA Declared Public Authority Under RTI by Karnataka Commission

The Karnataka State Information Commission has declared the Electronics City Industrial Township Authority (ELCITA) a “public authority” under the Right to Information (RTI) Act. This means ELCITA must now provide information within a fixed time when asked. The commission said ELCITA, though without elected members, was created by the government and has full powers like a local body, including tax collection. Established under the Karnataka Municipalities Act, ELCITA manages town affairs like development, finance, roads, water, and cleanliness.
Commissioner Rudranna Harthikote made the order after Ganesh Kumar M. appealed for details on development projects and tendering. Ganesh pointed out that a government gazette formed ELCITA and questioned its tax powers if it was private. ELCITA defended itself by citing court rulings saying it is not a public authority. But the commission noted Electronics City was developed by a Karnataka government agency in 1970 and transferred to the Electronics City Industrial Association in 1997. ELCITA was officially formed in 2013 to manage public services.
The commission highlighted that ELCITA shares 30% of collected taxes with three village panchayats. It added that any entity formed by government law or order and receiving government funding directly or indirectly is a public authority under the RTI Act. ELCITA also has government nominees on its management board. Citing precedent cases where the Tiruppur Area Development Board and Noida Authority were declared public authorities, the commission ordered ELCITA to appoint an assistant public information officer and a first appeal authority.
This move ensures more transparency and accountability in Electronics City’s administration under ELCITA.
