High Court Hearing on Iranian Refugee Deported to Nauru Despite Death Risks

An Iranian refugee known as TCXM is fighting deportation to Nauru in Australia’s high court. His lawyers say he faces a “real risk he will die” there due to his severe asthma. TCXM was given a 30-year visa for Nauru in February but was put back into detention after a 2023 high court ruling freed him.
His legal team says Nauru’s medical facilities are “inadequate” for his condition. They warn his removal could cause “imminent” and “preventable” death. Factors like his age, weather, and poor healthcare on Nauru could make his asthma worse.
The Australian government insists it must deport non-citizens under the law, citing a 2003 court ruling that said deportation is required "even if it is virtually certain that he or she will be killed".
TCXM arrived in Australia in 1990 and was granted a protection visa in 1995. In 1999, he was sentenced to 22 years in prison for murdering his wife. After his release, his visa was cancelled in 2015 and he was held indefinitely until a 2023 high court ruling set him free.
Australia acknowledges not sending him back to Iran for safety reasons.
In February 2024, Australia signed a $2.5 billion, 30-year deal with Nauru to house refugees like TCXM. So far, at least five men have been sent to Nauru under this agreement.
The government recently changed the Migration Act to remove the right to natural justice for people on deportation paths to Nauru. This stops them from getting fair hearings and blocks legal challenges to speed up removals.
Lawyers for TCXM say the law changes are invalid despite the government’s claims. The high court will decide if TCXM can be deported to Nauru or not.
